A pregnant woman outside the protection period may work up to 8.5 hours a day. Furthermore, a woman on maternity leave is not allowed to work at night from 8 p.m. to 5 a.m. Expectant mothers may not be employed if the life and health of mother or child is endangered by the work. Pregnant women are not allowed to work in the last six weeks before the date of birth unless they expressly agree to do so.
The declaration can be withdrawn at any time. In addition, the employer must exempt the pregnant woman or nursing mother from work if he cannot provide appropriate conditions. An important aspect of the Maternity Protection Act is protection against dismissal.
Protection against dismissal applies from the time of notification to the employer: four months after a miscarriage, which occurred after the twelfth week of pregnancy, until after four months after the birth. A further example would be the existence of an insolvency of a company. If the employer should nevertheless give notice of termination, an action can be filed within three weeks against the ineffective termination in the labor court.
